STAND ON CHARTER CHANGE ISSUE:

WHOSE Charter change train will make it first?

Even as the House committee on constitutional amendments has already approved House Resolution 1230 containing proposed amendments to the Constitution, Rep. Prospero Pichay said he was planning to introduce his own resolution with his proposed changes to the Charter.

And the Surigao del Sur congressman claims that his House Resolution 1285 has more signatures than the one that the committee approved.

Pichay said he would introduce his resolution when the entire House debates on HR 1230, which bore 173 signatures when it was introduced.

Cagayan de Oro City Rep. Constantino Jaraula, chair of the committee on constitutional amendments, House Speaker Jose de Venecia and Majority Leader Prospero Nograles are among the principal authors of HR 1230.

As of yesterday, Pichay said his resolution had “more or less the required three-fourths vote or 193 votes” needed for the House to approve constitutional revisions without Senate participation.

Pichay said he had also talked to some senators who were “very receptive” to his proposals.

Under Pichay’s resolution, all current members of Congress will constitute the interim parliament with parliamentary elections to be held on the second Monday of November 2007.

In the Jaraula proposal, it is the interim parliament that will set the date for “the first election under the new system.”

Pichay said his proposed amendments had a “good chance” of succeeding compared to those of HR 1230 because the latter included a concurrent resolution calling for the holding of a constituent assembly which has already been sent to the Senate.

Jaraula explained that HR 26, which was approved by the plenary November 2005 and which proposed to convene Congress into a constituent assembly to approve amendments to the Constitution, was the first of a two-step process to introduce amendment proposals. This was what was sent to the Senate.

The second step is HR 1230 which contains the actual proposed amendments to lift economic restrictions and abolish the presidential-bicameral system, replacing it with a parliamentary-unicameral system. This has yet to be approved by the plenary and has yet to be sent to the Senate.

Pichay argued that “Congress, once in session, had the power to revise the constitution” so there was no need for a concurrent resolution or, having passed one, to send it to the Senate for approval.

“If there is already a three-fourths vote in the House of Representatives, then it is not necessarily a requirement to get votes from the Senate,” Pichay said.
